He actually pulled off an surprising and hard fought win over Kongo (who you mention losing, so I'm not sure if you were talking about Herring having just lost to Nogeira or what; even then, if he wouldn't have hesitated he woulda spoiled Nog's debut big time) at UFC 82, so (sadly) I think he would actually be at the top of that list of people given, even if none of them really deserve it yet.
